Terms of Service

These Terms of Service (“Terms”) apply to your use of www.proventusenterprises.com and to any website design, social media management, or other services you buy from Proventus Enterprises LLC (“Proventus,” “we,” “us”). By using our website, requesting a free mockup, or purchasing a plan, you agree to these Terms.

1. Use of Website: You agree to use our website for lawful purposes only. Unauthorized use or misuse of the site is prohibited.

2. Free Mockups: Free homepage mockups cost nothing and come with no obligation to buy. A mockup is a design preview only. It doesn't include a live website, hosting, or the right to use our design unless you purchase a plan.

3. Purchases & Payment: Prices are listed on our Pricing page in U.S. dollars, and payments are processed securely by Stripe. Website plans are a one-time payment, due in full at checkout unless we agree otherwise in writing. Work begins once payment is received and we have the content we need from you, such as your logo, photos, list of services, and contact details.

4. Monthly Plans, Automatic Renewal & Cancellation: Social media management plans are billed monthly and renew automatically each month at the listed plan price until you cancel. Cancellation takes effect at the end of your current billing period, and you won't be charged again. We don't give partial refunds for the unused part of a billing period. If we ever change a plan's price, we'll tell you in advance, and you can cancel before the new price applies. You can cancel anytime by emailing info@proventusenterprises.com or online using the link below.

5. Refunds: You can request a full refund within 7 days of purchase as long as design work on your project hasn't started. Once work has begun, website payments are non-refundable, but we'll make the revisions included in your plan until the site matches what we agreed on.

6. Project Scope, Revisions & Timelines: Your plan includes the pages, features, and revisions described on our Pricing page or agreed with you in writing. Changes beyond that scope may be quoted separately. Timelines are estimates and depend on receiving your content and feedback promptly.

7. Your Content: You're responsible for the text, images, logos, and other materials you give us, and you confirm you have the right to use them. You allow us to use these materials to build and manage your website and social media accounts.

8. Ownership & Portfolio: Once your project is paid in full, you own the final website design and content we created specifically for you. We keep ownership of our general tools, templates, and know-how. Third-party items, such as stock photos, fonts, and platform software, remain subject to their own licenses. We may show your finished website or social media work in our portfolio unless you ask us not to.

9. Hosting, Domains & Third-Party Platforms: Hosting, domain names, and third-party platform fees are not included unless your plan says so. Websites may be hosted on third-party platforms such as Webflow, and social media work depends on networks like Instagram, Facebook, and TikTok. We aren't responsible for outages, policy changes, or account actions taken by those platforms.

10. No Guaranteed Results: We work hard to grow your business's online presence, but we can't guarantee specific search rankings, followers, engagement, leads, or sales.

11. Website Content & Testimonials: All content on this website, including design, text, images, and logos, is owned by Proventus Enterprises or licensed to us, and you may not reproduce or distribute it without permission. If you send us a testimonial or feedback, you allow us to use and share it publicly.

12. Disclaimers & Limitation of Liability: Our website and services are provided “as is.” To the fullest extent permitted by law, we aren't liable for indirect, incidental, or consequential damages, such as lost profits, and our total liability for any claim related to our services is limited to the amount you paid us in the 3 months before the claim.

13. Changes to These Terms: We may update these Terms from time to time. The Effective Date at the top of this page shows when they last changed. Changes won't apply retroactively to work you've already paid for.

14. Governing Law: These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. This doesn't take away any consumer protections you have under the laws of the state where you live.
